Terms of Service

These Terms form a binding agreement between you (the "Customer") and Corebyte Solutions LLC ("Corebyte", "Company", "we", "us") governing use of the Servbyte platform, dashboard, APIs, website, and monitoring agent (collectively, the "Service").

Overview

These Terms of Service ("Terms") constitute a legally binding agreement between the Customer and Corebyte Solutions LLC, a Wyoming limited liability company operating the Servbyte service. You accept these Terms by creating a Servbyte account, installing the Servbyte agent on any server, accessing the servbyte.io website while signed in, or otherwise using the Service.

If you accept these Terms on behalf of a company, partnership, or other organization, you represent and warrant that you have the authority to bind that organization, and "Customer" refers to that organization. If you do not have that authority, or if you do not agree to these Terms, you must not use the Service.

These Terms incorporate by reference our Privacy Policy, Acceptable Use Policy, and Refund & Cancellation Policy.

Eligibility & Account Use

You must be at least 18 years old and capable of forming a legally binding contract to use Servbyte. You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.

  • You are responsible for maintaining the confidentiality of your sign-in credentials, API keys, agent installation tokens, and any other authentication material issued to your workspace.
  • You are responsible for all activity that occurs under your account, whether or not you authorized it.
  • You must notify us immediately at contact@servbyte.io if you become aware of any unauthorized access to, or use of, your account.
  • Each individual or organization may maintain one Servbyte account. Credential sharing, account splitting, or the use of multiple accounts to circumvent plan limits, free trials, or usage caps is prohibited.

Subscription & Billing

Servbyte is offered in paid tiers — Hobby, Pro, and Team — with features and quotas as described on the pricing page. By selecting a plan you agree to pay the applicable fees for that plan.

  • Billing cycle. Subscriptions are billed monthly in advance on the anniversary of your sign-up date or your most recent plan change.
  • Payment processor. All payments are processed by Stripe, Inc., a PCI DSS Level 1 certified provider. Servbyte does not store your full card number, CVV, or bank account details.
  • Accepted methods. We accept Visa, Mastercard, and American Express through Stripe.
  • Failed payments. If a charge fails, Stripe will attempt several automatic retries. If payment is not recovered, we may suspend your workspace until the balance is settled.
  • Price changes. We may change subscription prices from time to time. Any price change will take effect no sooner than 30 days after we notify you by email or in-product notice.
  • Upgrades and downgrades. Upgrades take effect immediately and are prorated for the remainder of the current billing cycle. Downgrades take effect at the start of the next billing cycle.

Cancellation

You can cancel your subscription at any time from your billing settings inside the Servbyte dashboard. No phone calls, support tickets, or written notice are required.

  • Your subscription remains active until the end of the current billing period. After that, your workspace becomes read-only.
  • Workspace data is retained for 30 days after the end of your last paid period, after which it is permanently deleted from production systems.
  • If you reactivate your subscription within that 30-day window, your data is restored and your workspace resumes where it left off.

Refund Policy

We want you to be confident in Servbyte. If you are not satisfied with a new paid subscription, you may request a full refund within the first 14 days of a new paid subscription by emailing contact@servbyte.io from the email address on file.

  • After the initial 14-day window, we do not issue refunds for unused time on a monthly subscription.
  • Cancelling your subscription stops all future charges but does not automatically trigger a refund of past charges.

Acceptable Use

Your use of Servbyte is subject to our Acceptable Use Policy. You agree not to, and not to permit any third party to:

  • Deploy the Servbyte agent on, or otherwise monitor, infrastructure that you do not own or are not expressly authorized to monitor
  • Attempt to gain unauthorized access to any part of the Service, other customer accounts, or supporting systems
  • Introduce malicious code, launch denial-of-service attacks, or otherwise interfere with the integrity or performance of the Service
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Servbyte agent or the Service, except to the extent permitted by applicable law
  • Use the Service for any illegal or fraudulent purpose
  • Resell, sublicense, or provide the Service to third parties without our prior written consent
  • Circumvent or attempt to circumvent plan limits, quotas, rate limits, or billing controls

We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.

Intellectual Property

The Service, including the Servbyte agent, dashboard, APIs, documentation, website, design system, and Servbyte brand, and all related intellectual property rights, are and remain the exclusive property of Corebyte Solutions LLC and its licensors.

Subject to your compliance with these Terms and payment of applicable fees, Corebyte grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service, and to install and run the Servbyte agent on servers that you own or are authorized to manage, solely for your internal business purposes during your subscription term.

You retain all rights, title, and interest in and to your own data, including the telemetry your agents transmit to Servbyte. You grant us the limited rights necessary to receive, store, process, and display that data solely to deliver the Service to you.

Customer Data & Service Use

The Servbyte agent is designed to collect a narrow set of operational telemetry from the hosts you monitor:

  • CPU, memory, disk I/O, load average, network throughput, swap activity, and uptime
  • Service and port health (for example, HTTP endpoints and processes such as nginx, PostgreSQL, and Docker)
  • Aggregate process lists (top processes by CPU or memory)
  • Docker container metadata such as container names, images, and status

The agent does not collect, and Servbyte does not ingest:

  • Continuous application log streams beyond short, scoped snippets captured only when AI diagnostics are explicitly triggered
  • File contents from your servers
  • Environment variables, secrets, or API keys
  • Application database contents
  • Personal data belonging to your end-users

Customer data is used solely to provide, operate, and improve the Service for you. We do not sell customer data and do not use it for advertising. AI-assisted diagnostics operate on infrastructure signals only, run per-account in isolation, and are not used to train general-purpose AI models. Data is encrypted in transit with TLS 1.2 or higher and at rest with AES-256. Additional detail is available in our Privacy Policy.

Service Availability

The Service is provided on an "as is" and "as available" basis. While we invest significantly in reliability, we do not guarantee that the Service will be uninterrupted, error-free, or continuously available.

  • Scheduled maintenance will be announced in advance with reasonable notice through in-product messaging or on the System Status page.
  • We are not liable for downtime, degraded performance, or data ingestion delays resulting from causes reasonably beyond our control, including but not limited to upstream cloud provider outages, denial-of-service attacks, network failures, or force-majeure events.

Limitation of Liability

To the maximum extent permitted by applicable law, Corebyte Solutions LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the total fees you paid to Servbyte for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Servbyte is a monitoring and diagnostic tool. It does not replace, and is not a substitute for, your own backup, disaster recovery, incident response, or infrastructure management practices. You remain solely responsible for the systems you monitor with Servbyte and for the availability and integrity of the workloads that run on them.

Termination

You may terminate this agreement at any time by cancelling your subscription and deleting your account from the Servbyte dashboard.

We may suspend or terminate your access to the Service, with or without notice, if:

  • You materially breach these Terms or the Acceptable Use Policy
  • Your use of the Service creates a security or reliability risk to Servbyte, its customers, or third parties
  • Your account has been inactive with no active subscription for twelve (12) months or more
  • We are required to do so by law or by a lawful order of a competent authority

Upon termination, your right to access and use the Service ceases. Data is deleted in accordance with Section 4 (Cancellation). The following sections survive termination: Intellectual Property, Limitation of Liability, and Governing Law & Dispute Resolution.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Wyoming, and the parties consent to the personal jurisdiction of those courts.

Before initiating any legal proceeding, the parties agree to attempt in good faith to resolve the dispute informally by emailing contact@servbyte.io with a description of the issue and the relief sought. Formal proceedings may only be initiated if the dispute is not resolved within 30 days of that notice.

Modifications to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify workspace owners by email or by posting a prominent notice inside the Servbyte dashboard at least 30 days before the changes take effect. Non-material clarifications may take effect immediately upon posting.

Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of those updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
